What Is Required of You?
There are a number of requirements for people seeking to secure disability benefits. You must be willing to cooperate in providing evidence to prove your disability. Additionally, you may be asked to attend consultations and evaluations. What Is the Social Security Disability Process Timeline?
The process starts when you file a formal application for benefits with the SSA and it can take anywhere from 90 to 180 days to hear back. If your claim is denied, you have 60 days to appeal. It is important to have an experienced attorney on your side during the appeals process. The SSA will look at the claim and make a new determination, which can take an additional 90 to 180 days. If your appeal is denied, you have another 60 days to file a request a hearing with an administrative law judge. It may take two years to reach that hearing.
At the hearing with an administrative judge, you will be able to testify and present evidence to the judge. A formal written decision will be issued by the judge. If you are denied, another appeal can be filed within 60 days to request a review by the Appeals Council. This can be set out anywhere from six months to two years. If they deny your claim, you can file a complaint in federal court. Federal court is the final word, with the potential for your case to go through the court of appeals and beyond.
