What happens if my disability claim comes back denied?

When you are unable to work due to a disabling medical condition or illness, you know how difficult it can be to simply support yourself and your Ohio family financially. While you may know that you could be eligible for financial support through Social Security Disability benefits, you may not know how to actually go about securing that support.

One of the most frustrating aspects of the disability claims process is the fact that many claims come back denied. In fact, most initial applications are not successful. A denied claim, while frustrating, is not the end of the road. You actually have the right to appeal and request reconsideration of your claim.

Why did my claim come back denied?

Even individuals with valid claims find that their attempts at securing disability benefits do not always go as planned. There are several reasons why the SSA denies claims, including the following:

  • The SSA does not believe the claimant's injury is severe enough to qualify.
  • The SSA believes that the claimant can still work his or her normal job.
  • The SSA thinks that the injury or illness is the result of a problem with either drugs or alcohol.
  • There was insufficient medical evidence included with the claim.
  • The SSA believes that the claimant did not cooperate with the prescribed treatment plan.
  • The claimant did not prove the validity of the injury before he or she returned to work.

No matter the reason given for a denied disability claim, you always have the right to seek a different outcome through an appeal.

How do I appeal?

There are various options available to you, but one of the first steps could be to file for a reconsideration of your claim. This can allow you to present new evidence to dispute the SSA's ruling. Additional medical reports can strengthen your claim, including medical history, notes from your doctor and other evidence.

It is possible, even after a strong effort for reconsideration, that your claim could come back denied again. While frustrating, you may then continue to fight by appealing the reconsideration decision.

You don't have to fight alone

The disability claims process is complex and fraught with challenges. Fortunately, you do not have to fight alone. You have the right to support and guidance from the very beginning, even before you file your initial claim. Getting the support you need is important, and you would be wise to make sure you have a strong and experienced ally on your side.
