How To Know If You Have A Valid SSD Claim
The process of obtaining Social Security Disability (SSD) benefits is complex. Indeed, the confusion sets in from the very start — many individuals are uncertain whether they are even eligible to apply.

Do you think I have a legitimate claim?
To receive SSD benefits, you must prove to the Social Security Administration that you have a qualifying condition and that this condition has rendered you unable to work for at least 12 months.
The Social Security Administration considers a wide variety of ailments, both physical and psychological. The chief consideration is whether you are legitimately unable to work. As such, enlisting the support of a qualified physician is crucial to every claim.
When should I file?
You should apply for benefits as soon as you become disabled — though after you have gathered together all of the relevant documentation to establish your disability.
Processing your application may take several months. As such, filing early is the surest way to receive your benefits in a timely manner. It is important to note you do not need to wait until you have been out of work for 12 months to file; rather, you must only demonstrate that your condition is expected to prevent you from working in the long term.
How long does the process take?
The length of time it takes to adjudicate a claim varies from case to case. While some cases are processed within four months, some take up to two years. Individuals with unusually severe conditions, however, often have their cases processed more quickly.
To expedite proceedings, and to bolster your chances of success, it is important to present your medical history as thoroughly, and with as much supporting evidence as you can assemble, at the very outset.
When will I receive payments?
Once your application is approved, it generally takes one or two months before you will receive your first check from the Social Security Administration. The wait will be somewhat longer to receive any back pay you are owed.
If you and your dependents don’t begin to receive benefits within 90 days, contact the Social Security Administration — or have one of our attorneys do so on your behalf.
What if my claim is rejected?
The majority of initial claims are rejected. This should not be interpreted as a sign that your claim is invalid, however. An attorney can help you appeal your case and obtain a favorable outcome.
