What’s The Timeline?

The process starts when you file a formal application for benefits with the SSA. It could take anywhere from 90 to 180 days to receive their response. During this time, the SSA has a chance to evaluate your work history, previous earnings, medical condition, and other factors.

If your claim is denied, you have 60 days to appeal. It is important to have an experienced attorney on your side during the appeals process. The SSA will look at the claim and make a new determination, which can take an additional 90 to 180 days. If your appeal is denied, you have another 60 days to file a request for a hearing with an administrative law judge. This is where patience comes into play; it may take two years to reach your administrative hearing.

At your hearing, you will be able to testify and present evidence to the judge. A formal written decision will be issued and, once again, if you are denied you can file an appeal within 60 days to request a review by the appeals council. This review, too, can be set out anywhere from six months to two years. If they deny your claim, you can file a complaint in federal court.
